Health.md Terms of Use

The app records which version of these terms you accepted and when. Bump the version string here and ConsentRecord.currentVersion in App/Features/Onboarding/OnboardingFlow.swift together whenever the substance changes — the app re-prompts when they differ.

1. What Health.md is

Health.md is an educational reference tool. It helps you understand published medical information and prepare for conversations with your clinician.

2. What Health.md is not

Health.md is not a medical device. It does not diagnose conditions, does not recommend or adjust treatment, does not prescribe, and does not provide dosing information. It does not perform triage and does not tell you how urgent your situation is beyond surfacing general urgent-care guidance when your wording suggests an emergency.

Health.md is not a substitute for professional medical advice, diagnosis, or treatment. It has no knowledge of your full medical history, and nothing it shows you has been reviewed in the context of your particular situation.

Never disregard professional medical advice, or delay seeking it, because of something you read in Health.md.

3. Emergencies

If you think you may have a medical emergency, call 911 or your local emergency number immediately. For a mental-health crisis in the US, call or text 988.

Health.md includes automatic detection of emergency wording, which runs before any AI and shows urgent-care guidance. This is a safety net, not a diagnostic system. It can miss things. Never rely on the absence of an urgent warning as evidence that your situation is not urgent.

4. The reference library

Health.md quotes published medical sources — primarily US federal public-domain health publications including MedlinePlus, the National Institutes of Health, the Centers for Disease Control and Prevention, NCI PDQ patient summaries, and US Preventive Services Task Force statements.

This library has not yet been reviewed by a licensed clinician. Passages are labeled "Draft" until they have been. Because it is unreviewed, Health.md shows source material as exact quotations with their attribution rather than rewriting it — you see what the source said, not our summary of it.

Medical knowledge changes. Sources may be outdated, may not reflect the latest guidance, and may not apply to you.

5. Your responsibilities

You agree to use Health.md for personal educational purposes only, not to rely on it for medical decisions, and not to use it for anyone else's care. You are responsible for the accuracy of the information you enter.

You must be 18 or older.

6. Your data

Your health information is stored on your device. See the Privacy Policy for exactly what is stored, what leaves your device, and how to export or delete it.

Your data is deliberately excluded from iCloud backups. You are responsible for exporting it before switching or erasing devices. We cannot recover it — we never had a copy.

7. No warranty

Health.md is provided "as is," without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the information it presents is accurate, complete, current, or applicable to you.

8. Limitation of liability

To the maximum extent permitted by law, MetaPV is not liable for any indirect, incidental, consequential, special, or exemplary damages, or for any damages arising from your use of or reliance on Health.md, including any health outcome influenced by information it presented.

[Counsel: confirm the cap, the carve-outs required in your jurisdiction, and whether a liability limitation is enforceable against personal-injury claims here. This clause is the one most likely to need substantial rewriting.]

9. Changes

We may update these terms. When the substance changes materially, the app will ask you to review and accept the new version before continuing.

Notes for counsel

1. FDA posture. These terms are written for the General Wellness / non-device lane. Section 2's disclaimers are load-bearing for that posture and are mirrored in the app's onboarding, its per-answer footer, and its deterministic refusal of diagnosis and dosing questions. Confirm the framing holds given the app covers roughly 1,750 conditions with symptom information — breadth alone can make a product *look* like a symptom checker even when it never ranks or scores possibilities. 2. Unreviewed content. Section 4 discloses that no clinician has reviewed the library. Confirm this disclosure is sufficient, and whether the verbatim-quotation approach (rather than paraphrase) affects the analysis — it is the specific mitigation the product relies on. 3. Arbitration / class waiver / governing law. Not included. Advise. 4. Age gate. Set at 18 with no verification. Confirm adequacy. 5. Marketing alignment. The business plan commits to a claims style guide; App Store copy, website, and ads must not make claims these terms disclaim.
